Terms and policies.

These terms govern your free evaluation of the Adaptive AI Governance features you select (the “Product”). By checking the box or activating the Product, the organization accepting them (“Customer”) agrees to these terms, and the person accepting confirms they are authorized to do so for Customer. This agreement is between Customer and TeamGuard AI, Inc. d/b/a Adaptive Security (“Adaptive”).

1. The evaluation. Adaptive grants Customer a limited, non-transferable, revocable right to use the Product for its own internal evaluation during the Evaluation Period. The Product is for assessment only and should not be relied on for production monitoring or compliance. Adaptive owns and retains all right, title, and interest in the Product and all related technology and intellectual property and may use any feedback that Customer provides about the Product for any purpose.
2. Length. The “Evaluation Period” runs for 14 days from activation and then ends automatically unless Adaptive extends it in writing. Either party may end the evaluation sooner, for any reason. Sections 3 through 7 continue to apply after it ends. If Customer subscribes to a paid plan, the Adaptive Master Subscription Agreement and Data Processing Addendum referenced in its Order Form replace and supersede these terms.
3. Your data and authority. Customer may enable the Product to collect browser and on-device activity data from its users’ environments, including its users’ interactions with AI tools and services and the content submitted to them (the “Evaluation Data”). Customer confirms it has the rights and legal basis to provide that data and to allow the use described below, and that it has given any notices and obtained any consents its users or applicable law require.
4. How Adaptive uses the data. Adaptive uses Evaluation Data to provide and secure the Product for Customer. Adaptive analyzes browser and on-device activity, the AI tools and services used, the content and data submitted to them, and related metadata to identify and report AI-related risks and policy violations. Within 30 days after the evaluation ends, Adaptive will delete Evaluation Data.
5. No warranties. The Product is provided “as is,” without warranties of any kind, express or implied, and Adaptive provides no support or service-level commitments.
6. Liability. Neither party is liable to the other for indirect or consequential damages. To the maximum extent permitted by law, Adaptive has no liability or indemnification obligation arising out of the evaluation. These limits do not apply to a party’s breach of Section 3. Nothing in these terms excludes any liability that cannot be excluded under applicable law.
7. General. If Customer already has an agreement with Adaptive, these terms cover the evaluation only and do not change that agreement, which continues to govern Customer’s other products and services. These terms are the entire agreement for the evaluation, and if any part is unenforceable the rest stays in effect.
